These Terms & Conditions (hereinafter referred to as the "Terms") apply to all your actions of accessing, using the official website of YOLOPAINTING (hereinafter referred to as the "Site"), ordering handcrafted custom oil painting products (hereinafter referred to as the "Products") and enjoying related services through the Site. The Site is operated by YOLOPAINTING. Before using the Site and related services, you shall carefully read and understand all the contents of these Terms. Your access, registration, order placement and any other use shall be deemed as having fully understood and agreed to be bound by these Terms. If you do not agree to these Terms, please do not use the Site and related services.

These Terms apply to both guest users and registered users. The Privacy Policy of YOLOPAINTING is an integral part of these Terms. By accepting these Terms, you are deemed to accept all the provisions of the Privacy Policy at the same time.

1. Access and Use of Services


  1. The Site provides you with exclusive services such as submission of oil painting custom requests, order payment, production progress inquiry and logistics tracking. YOLOPAINTING reserves the right to temporarily adjust, suspend or terminate part or all of the services without prior notice, and shall not be liable for any unintentional losses caused thereby.
  2. The Site may open exclusive functions to registered users. Unregistered users may complete orders as guests, but the service functions available to them may be restricted.
  3. If you obtain an account and password through registration, you shall keep the account information in safe custody and bear full responsibility for all operational acts under the account. You shall not lend, rent or sell the account to a third party without permission. If you find unauthorized access, information leakage or other circumstances of the account, you shall immediately notify us; otherwise, you shall bear all losses caused thereby.
  4. We have the right to disable, freeze or cancel your account at any time without prior notice when we find that you have violated these Terms and relevant rules.
  5. You warrant that all personal information, custom requests, reference photos and other contents provided by you when using the Site's services are true, legal and valid, and you shall not use others' information without authorization or submit illegal, irregular and infringing contents. Otherwise, we have the right to refuse to provide services and pursue your corresponding liabilities.

2. Order and Transaction Rules


  1. Once you submit a custom request, confirm the order information and complete the payment on the Site, it shall be deemed that a formal custom service contract relationship has been established with YOLOPAINTING. The order information (including custom requirements, painting size, framing type, shipping address, payment amount, etc.) is the core content of the contract, and both parties shall strictly perform their obligations.
  2. You shall carefully check the order information before placing an order. If production errors, shipping delays, undeliverable packages and other problems are caused by incorrect information provided by you (such as wrong shipping address, contact information, unclear description of custom requirements, etc.), you shall bear the corresponding consequences by yourself. YOLOPAINTING may assist in the handling, but any additional costs incurred thereby shall be paid by you.
  3. For custom orders requiring confirmation of production effects, we will send you the draft/sample of the painting for review and confirmation:
    • You shall reply with your opinions within 24 hours upon receipt of the confirmation notice; if no reply is received after the expiration, we will send a reminder email once;
    • If no reply is received within 24 hours after the email reminder, we will send another reminder via SMS;
    • If no reply is received after the SMS reminder, it shall be deemed that you approve the production effect, and we will continue to complete the subsequent production and shipping process.

  4. The payment methods supported by the Site will be clearly displayed on the checkout page, and you may only complete the order payment through such payment methods. The payment process is processed by a third-party payment gateway. We do not store your original payment information such as bank card and credit card, and the payment security is guaranteed by the third-party payment institution.
  5. For payment failures, duplicate orders and other problems caused by non-our reasons such as system failure, network delay and abnormal payment channels, we will assist you in verification and handling, but shall not bear direct compensation liability.
  6. We have the right to refuse to process any order or terminate services within a reasonable scope according to the actual situation, including but not limited to finding abnormal order information, suspected fraud, irregular custom contents and other circumstances, and shall not be liable for compensation to you or any third party. If the order has been paid, we will process a full refund for you after verification.

3. Product Production and Shipping


  1. All Products on the Site are handcrafted custom creations according to your requirements. The production cycle shall be subject to the announcement on the Site and the marking on the order page. The production cycle may be appropriately extended during holidays and peak order periods, and we will promptly inform you of the progress changes.
  2. The shipping service shall comply with all the provisions of the Shipping Policy of the Site. The shipping costs, shipping time limit, logistics tracking, relevant rules for international shipping and other matters shall be subject to the Shipping Policy.
  3. After the Product is completed and shipped, we will send you the logistics tracking information via email, through which you can query the shipping progress. For shipping delays, lost packages, damage and other problems caused by the logistics carrier, we will assist you in filing a claim with the carrier and perform the corresponding after-sales liabilities in accordance with the Shipping Policy at the same time.
  4. If you need to modify the logistics information such as shipping address and contact information, you shall submit an application to us before the Product is shipped. The modification of logistics information is not supported after the Product is shipped, and you shall bear all consequences such as undeliverable packages caused thereby.

4. Return, Exchange and After-Sales Rules


  1. Since the Products of the Site are 100% handcrafted custom products with uniqueness, no reason returns or exchanges are not accepted unless the Products have production errors (such as serious inconsistency with reference photos, unfulfilled custom requirements, wrong subject content) or craft defects/quality problems (such as canvas tearing, paint peeling, frame cracking and other non-shipping and man-made reasons).
  2. If the Product you receive has the above problems, you shall contact us within 15 days after signing for receipt and provide clear proof materials such as product photos/videos and package photos. After verification, we will re-create and ship a new Product for you free of charge, or process the corresponding refund according to your requirements.
  3. Product problems caused by your personal reasons (such as change of aesthetic preference, temporary change of custom requirements, etc.), damage due to force majeure during transportation, improper unpacking by yourself, man-made damage and other circumstances shall not be applicable to the above after-sales rules. We may provide paid repair/re-creation services, and the relevant costs shall be borne by you.
  4. If the custom reference photos you submit contain obscene, pornographic, violent, illegal and irregular and other harmful contents, we have the right to cancel the order directly. If the order has been paid, a full refund will be processed for you, only the involved custom products will be cancelled, and other compliant products in the same order will be produced and shipped normally.

5. Intellectual Property and Content Norms


  1. YOLOPAINTING enjoys complete intellectual property rights to all contents of the Site (including but not limited to words, pictures, logos, design styles, page layout, etc.). Without written authorization, no unit or individual may copy, disseminate, modify or use them without permission.
  2. You warrant that you have legal intellectual property rights or the right to use all contents such as reference photos and custom requirements submitted through the Site, and have not infringed the legitimate rights and interests such as portrait right, copyright and privacy right of any third party. If YOLOPAINTING suffers third-party complaints, claims, litigation and other consequences due to the contents submitted by you, you shall bear full liabilities and compensate YOLOPAINTING for all losses suffered thereby (including but not limited to compensation, litigation costs, attorney fees, etc.).
  3. You shall own the physical ownership of the finished custom oil painting works created by us for you, and YOLOPAINTING shall enjoy the copyright of the painting works. Without our written consent, you shall not use the painting works for commercial purposes. If you need to use the works for commercial purposes, you shall negotiate with us in advance and obtain written authorization.

6. Liability Exemption and Limitation


  1. The Site and related services are provided on an "as is" basis. YOLOPAINTING has made reasonable efforts to ensure the normal operation of the services, but does not make any express or implied warranties, including but not limited to product quality, service timeliness, trouble-free operation of the Site, etc.
  2. If we are unable to perform or delay the performance of our obligations under these Terms due to force majeure (including but not limited to natural disasters, wars, epidemics, government policy adjustments, network failures, operator service interruptions, logistics carrier breaches, etc.), we shall not be liable for compensation, and may partially or fully exempt from the performance of obligations according to the impact of force majeure. We will resume the services as soon as possible after the force majeure circumstances disappear.
  3. Unless otherwise agreed in these Terms, YOLOPAINTING shall not be liable for any indirect losses, incidental losses, expected interest losses and other losses incurred by you due to the use of the Site's services.
  4. No provision in these Terms shall exclude or limit our compensation liability for your personal injury and property losses caused by intentional or gross negligence, nor shall it exclude or limit the non-exemptible compensation liability stipulated by laws and regulations.

7. Modification and Update of Terms


YOLOPAINTING has the right to modify, supplement or update these Terms at any time according to business development, changes in laws and regulations and other circumstances. The modified Terms will be published in a prominent position on the Site and shall take effect on the date of publication, replacing the original Terms.

You shall regularly check the updated contents of these Terms. If you continue to use the Site and related services after the update of the Terms, it shall be deemed that you have fully understood and agreed to accept the modified Terms; if you do not agree to the modified Terms, you shall immediately stop using the Site and related services.

8. Force Majeure


If we are prevented from or delayed in performing any of our obligations under these Terms due to objective circumstances beyond the reasonable control of YOLOPAINTING (including but not limited to natural disasters, government acts, wars, national emergencies, riots, fires, floods, inclement weather, epidemics, strikes, logistics carrier restrictions, shortage of raw material supply, etc.), our performance obligations shall be postponed accordingly until the objective circumstances are eliminated, and we shall not be liable for any compensation to you.

9. Other Provisions


  1. Waiver: Our failure to exercise the rights agreed in these Terms in a timely manner or to require you to strictly perform the obligations agreed in these Terms shall not be deemed as a waiver of such rights, nor shall it exempt you from the subsequent performance of obligations. Our waiver of any breach of contract shall not be deemed as a waiver of subsequent similar breaches of contract.
  2. Severability: If any provision of these Terms is determined to be invalid, illegal or unenforceable by a competent judicial authority, the invalid part of such provision shall not affect the validity of other provisions, and other provisions shall continue to be valid and enforceable.
  3. Entire Agreement: These Terms, together with the Privacy Policy and Shipping Policy of the Site, constitute the entire agreement between you and YOLOPAINTING, and supersede all previous oral or written agreements and understandings reached by both parties in respect of the Site's services.
  4. Third-Party Rights: These Terms shall only bind you and YOLOPAINTING, and no third party shall have the right to claim any rights on the basis of these Terms.
  5. Governing Law and Jurisdiction: The formation, performance, interpretation and dispute resolution of these Terms shall be governed by the laws of the People's Republic of China. Any dispute arising from these Terms shall first be settled by both parties through friendly negotiation; if the negotiation fails, either party has the right to file a lawsuit with the people's court having jurisdiction at the place where YOLOPAINTING is located.

YOLOPAINTING reserves the final right of interpretation of these Terms & Conditions.
